These Terms of Service (“Terms”) govern access to and use of the website located at https://bharatatomics.com, any related staging or subdomain sites, and the information, content, and materials made available through them (collectively, the “Website”) operated by Bharat Atomics (“Bharat Atomics,” “we,” “our,” or “us”).

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.

These Terms apply to the public Website. They do not govern the design, licensing, construction, operation, or sale of nuclear facilities, electricity, or any commercial product. Those matters, if any, are covered only by separate written agreements.

1. Eligibility and Acceptance

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Website.

If you are using the Website on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

2. About Bharat Atomics and the Website

Bharat Atomics is developing sodium-cooled fast reactor technology, including the ATLAS-150 design described on the Website, with the aim of providing firm, clean energy for applications such as industry, data centres, grids, process heat, and related uses.

The Website is an informational and corporate site. It may include company information, technology descriptions, specifications, timelines, FAQs, contact forms, and careers information.

We may modify, suspend, or discontinue any part of the Website at any time without liability.

Nothing on the Website:

Constitutes an offer to sell, or a solicitation to buy, securities or any investment product
Constitutes an offer to supply electricity, heat, hydrogen, or a reactor
Creates a partnership, joint venture, employment, or agency relationship
Is a filing with, or approval by, any nuclear, environmental, or other regulator

3. Informational Nature of Content

Content on the Website, including reactor specifications, timelines, safety descriptions, performance figures, and design status, is provided for general information only.

Such content may be conceptual, indicative, or subject to change as design, testing, manufacturing, siting, and regulatory work progresses. It does not constitute:

Professional, engineering, nuclear, environmental, legal, financial, or regulatory advice
A warranty of technical performance, schedule, cost, licensability, or deployability
A representation that any design has been licensed, constructed, or operated

You should not rely on Website content as the basis for investment, contracting, siting, or engineering decisions. Independent professional advice is required.

4. User Responsibilities

No rights are granted except a limited, revocable, non-exclusive licence to access and view the Website for lawful, non-commercial informational purposes.

You may not reproduce, distribute, modify, publicly display, or create derivative works from Website content without our prior written consent, except for fair dealing or other uses permitted by law.

ATLAS-150, Bharat Atomics, and related names, marks, and logos are identifiers of Bharat Atomics. You may not use them in a way that suggests endorsement, partnership, or origin without our written permission.

7. Confidentiality and Unsolicited Materials

Each party agrees to protect the other party’s confidential information that is clearly identified as confidential and shared in connection with a bona fide discussion, using reasonable care, and to use such information solely for that discussion.

We do not accept unsolicited ideas in confidence through the Website. If you send us concepts, proposals, designs, or other materials without a prior written non-disclosure agreement:

You grant Bharat Atomics a non-exclusive, worldwide, royalty-free right to use, review, and consider those materials for any lawful purpose
We have no duty to return, acknowledge, or keep those materials secret
You represent that you have the right to share them and that doing so does not breach any third-party obligation

Do not send us third-party confidential information, export-controlled technical data, or classified material through Website forms.

8. Fees and Commercial Terms

Access to the public Website is free.

Certain products or services, including any future supply of electricity or related commercial offerings, may be subject to fees under separate written agreements. Website use does not create any payment obligation.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHARAT ATOMICS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS COMPLETE, CURRENT, OR RELIABLE.

NUCLEAR ENERGY PROJECTS ARE SUBJECT TO LAW, LICENSING, SITING, SUPPLY CHAIN, FINANCING, AND TECHNICAL RISK. NOTHING ON THE WEBSITE REDUCES THAT RISK OR REPLACES REGULATORY APPROVAL.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHARAT ATOMICS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE WEBSITE.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT, IF ANY, YOU PAID TO BHARAT ATOMICS SPECIFICALLY FOR ACCESS TO THE WEBSITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) INR 10,000.

THIS LIMITATION DOES NOT AFFECT LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

12. Indemnity

You agree to indemnify and hold harmless Bharat Atomics and its directors, officers, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Website, your submissions, or your breach of these Terms.

13. Termination

We may suspend or terminate access to the Website at any time for violation of these Terms, suspected abuse, or as required by law.

Upon termination, the licence granted to you immediately ceases. Sections that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law, will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Subject to applicable law, courts at Bengaluru, Karnataka, India shall have exclusive jurisdiction over disputes arising out of or relating to the Website or these Terms.

15. Changes to Terms

We may update these Terms from time to time. The “Effective date” at the top will reflect when changes were last made. Continued use of the Website after changes become effective constitutes acceptance.
